Idaho Parental Choice Tax Credit Audit: Receipt Rules, Documentation, and Clawback Penalties

Every Application Is Subject to Audit

The Idaho State Tax Commission has the statutory authority to audit any Parental Choice Tax Credit claim. This isn't a targeted enforcement program aimed at suspicious filings — it's a blanket provision. Every application and every tax return claiming Line 42 can be reviewed.

Understanding what the Tax Commission looks for, and building your documentation around those requirements from day one, is the difference between a clean confirmation and a clawback notice.

What Your Receipts Must Show

Idaho law requires you to retain all original paid receipts for at least four years after your filing date. Each receipt must include four pieces of information:

  1. Provider name and contact details — the business or individual who sold you the product or service
  2. Specific item or service description — "Saxon Math 5/4 Student Textbook" passes; "school supplies" doesn't
  3. Date and dollar amount — the exact date you paid and the exact amount
  4. Proof of completed payment — a zero balance, paid stamp, or transaction confirmation

Bank statements can supplement receipts but don't replace them. A credit card charge showing "$47.82 at Amazon" doesn't tell the Tax Commission what you bought or which core subject it serves.

The Mileage Log Standard

If you're claiming transportation expenses, you need a contemporaneous mileage log — meaning you record each trip when it happens, not at the end of the year from memory. Each entry needs:

  • Date of the trip
  • Starting point and destination
  • Purpose (driving student to/from nonpublic school or instructional facility)
  • Total miles driven

A notebook in the glove compartment, a spreadsheet updated weekly, or a mileage tracking app all work. What doesn't work is reconstructing 180 school days of driving the night before filing.

Advance Payment Reconciliation

If you received an advance payment (available to families at or below 300% FPL), you face an additional documentation step: mandatory electronic reconciliation through your TAP account.

Log into TAP, navigate to the Parental Choice Tax Credit Dashboard, upload itemized receipts for every dollar disbursed, and complete the reconciliation by the deadline (December 31 of the year following your award — for 2026 advance payments, that's December 31, 2027).

Missing this reconciliation isn't just a paperwork inconvenience. It can trigger the same disallowance and clawback provisions as a failed audit.

What Happens When Expenses Are Disallowed

If the Tax Commission determines that you claimed non-qualifying expenses or can't produce adequate documentation, the consequences escalate:

Recapture. You must repay the disallowed credit amount. If you claimed $4,200 and $800 was spent on expenses the Tax Commission deems non-qualifying, you owe that $800 back.

Interest and penalties. Interest and a financial penalty might apply to unpaid disallowances.

Fraud prosecution. If the Tax Commission finds willfully false, fraudulent, or altered documentation, the case can be referred for felony criminal prosecution under Idaho law. This isn't about honest mistakes — it targets fabricated receipts, inflated amounts, or forged documents.

Common Audit Triggers

The statute doesn't list specific audit triggers, but the categories most likely to draw scrutiny based on the program's design:

Bulk retail purchases without itemization. A $300 order from a general retailer with no line-item detail describing each item's core-subject function.

Tutoring payments to related parties. The anti-family-tutor rule is explicit. Claims for tutoring that can't demonstrate the provider is unrelated to the household raise flags.

Expenses also claimed under Empowering Parents. The Tax Commission cross-references claims against State Board of Education grant records. Duplicate claims between the two programs can be caught.

Transportation claims without a mileage log. If you claim $1,200 in transportation and can't produce a log with dates, destinations, and miles, the full amount gets disallowed.

Building an Audit-Proof System

The most effective approach is treating documentation as an ongoing habit, not a year-end scramble:

  • Create a folder (physical or digital) for each tax year
  • File every receipt immediately after purchase, annotated with the core subject it serves
  • Update your mileage log weekly at minimum
  • Keep a running total of expenses by category so you know where you stand against the per-student cap
  • Separate expenses funded by the Empowering Parents grant from those you'll claim under the tax credit
