Idaho Parental Choice Tax Credit Eligibility: Income Limits, Amount, and the $50 Million Cap
Who Qualifies
Four conditions must all be true for a family to claim the Idaho Parental Choice Tax Credit:
Full-year Idaho residency. Both the parent or legal guardian and the student must be Idaho residents for the entire tax year — not part-year. If you moved to Idaho from another state mid-year, you become eligible starting the first full calendar year after establishing permanent domicile.
Non-public school enrollment. The student cannot be enrolled full-time in an Idaho public school district or public charter school. This is strict — enrolling in a public school for even a single course or extracurricular activity disqualifies the student for any semester where that enrollment exists.
Student age. The student must be between 5 and 18 years old at any point during the tax year. Students with qualifying disabilities can be up to 21.
Prior-year tax return filed. The Tax Commission needs at least one processed Idaho Form 40 on file before you can register on the TAP portal and apply.
Active-duty military stationed in Idaho but maintaining legal residency in another state do not qualify — the credit requires Idaho residency for tax purposes, meaning you file a Form 40 as a full-year resident.
How Much Is the Credit Worth?
The credit reimburses dollar-for-dollar what you actually spent on qualified education expenses, up to these per-student caps:
- Standard students: up to $5,000 per student per tax year
- Students with qualifying disabilities: up to $7,500 per student per tax year
There's no limit on how many children one household can claim. A family with four nonpublic-school students could claim up to $20,000 in total credits — the per-student caps are individual, not household-wide.
The credit is fully refundable. If your Idaho income tax liability is zero, you still receive the full credit amount as a direct refund. This matters especially for lower-income families who may not owe state taxes at all.
The $50 Million Cap and Priority Tiers
Idaho caps the total Parental Choice Tax Credit program at $50 million per year. When applications exceed available funds, the Tax Commission distributes money using income-based priority tiers.
For applications received in 2026 (for the 2025 tax credit):
- Tier 1 — Priority allocation: Households with Modified Adjusted Gross Income (MAGI) at or below 300% of the Federal Poverty Level process first. For a family of four, the threshold was $93,600 using the 2024 guidelines.
- Tier 2 — General allocation: Higher-income families go on a waitlist and process only after all Tier 1 applicants are funded. Within the waitlist, applications process in the order they were submitted.
Starting with the 2027 application period (for the 2026 tax credit), parents who received a credit award in 2026 and completed the required satisfaction and engagement survey get processed first. Other applicants whose taxable income on their most recently filed return is at or below 300% of the Federal Poverty Level get the next priority ($96,450 for a family of four using 2025 guidelines), followed by all other complete applications in submission order if funds remain. This is a priority rule, not a funding guarantee; awards remain subject to eligibility and the $50 million cap.

What Happens If the Cap Fills Up?
The first application cycle showed strong demand: 7,055 applications representing 12,561 students. If total claims exceed $50 million, the Tax Commission works through priority applicants first, then processes waitlisted applications until funds run out.
If you're waitlisted and the cap is exhausted, your application is denied for that tax year. You'd need to reapply in the next cycle.
