The Injunction That Froze the Program

The West Virginia Legislature enacted the Hope Scholarship through House Bill 2013 in 2021, creating one of the nation's broadest Education Savings Account programs. The prohibition against special legislation. The court rejected the argument that the Hope Scholarship constituted impermissible special legislation, finding the program applied generally to eligible families across the state rather than singling out specific groups for special treatment.

The ruling cleared the program to operate, and enrollment began growing — from 2,333 students in 2022–23 to over 14,000 by 2025–26.

Ongoing Legal Challenges

State v. Beaver resolved the "facial" constitutional challenge — the question of whether the law itself is valid on its face. It did not resolve every possible legal argument against the program.

Active litigation continues through cases like Hometown Hope v. West Virginia Department of Education, which brings "as-applied" challenges. These suits argue that rapid student exits from public schools in specific rural counties — including Mingo County and Randolph County — have caused public school budget deficits, school closures, and excessive bus transit times that harm the students who remain. The argument is not that the Hope Scholarship is unconstitutional everywhere, but that its implementation in certain economically distressed areas creates unconstitutional burdens.

As of 2026, no court has issued an injunction against the universal expansion. The as-applied cases continue through lower court proceedings without blocking families from applying or receiving funds.
