Who Sits on the Board
The Board has nine members established under W. Va. Code §18-31-3. Six are ex-officio state officials who serve by virtue of their position:
- The State Treasurer (or designee)
- The State Auditor (or designee)
- The Attorney General (or designee)
- The State Superintendent of Schools (or designee)
- The Chancellor of Higher Education (or designee)
- The Director of the Herbert Henderson Office of Minority Affairs (or designee)
Three seats are filled by parent members appointed by the Governor with Senate consent for three-year terms. By statute, these parent appointees must represent geographically diverse areas of West Virginia. Since July 2024, the law also requires them to come from families engaged in different educational models — microschools, home-based instruction, and participating private institutions.
The State Treasurer's Office provides operational staffing and handles day-to-day program administration, including portal management, application processing, and vendor coordination through the TheoPay platform.
What the Board Actually Decides
The Board's most consequential power for participating families is expense determinations — rulings on whether specific items or categories qualify for Hope Scholarship spending under W. Va. Code §18-31-7. When TheoPay rejects a purchase, Account Holders can use the portal's Qualified Expense Request appeal process; follow the current portal instructions for submitting it.
Current rules families often need to check include:
- The biennial (once every two calendar years) limit on primary computing devices per student
- Qualifying supplemental arts and activities, such as musical instruments, art curriculum, and museum or zoo entry
- Provider registration standards, including Control Employee Form requirements
How to Track Board Decisions
Board meetings are public, and meeting minutes are published on the Hope Scholarship website (hopescholarshipwv.gov). The minutes record Board discussions and decisions; check the current Parent Handbook and portal guidance before relying on a purchasing rule.

The Board also has authority under W. Va. Code §18-31-10 to audit student accounts. If an audit finds intentional misuse of funds, the enforcement actions are severe: account freezing, mandatory restitution, permanent program disqualification, and referral to the Attorney General for potential criminal fraud investigation.
