Tennessee EFS Priority Tiers Explained: How Awards Are Actually Distributed

Most parents assume the Tennessee Education Freedom Scholarship operates like a random lottery — submit your application and hope your name gets drawn. That assumption has cost thousands of families their spot. EFS awards are distributed through a strict five-tier priority system defined in state law. Your renewal status, income, benefit eligibility, and public-school enrollment determine the tier; submitted documents verify those facts.

In the 2026-2027 cycle, 56,440 applications were submitted for 35,000 available seats, and 17,735 applications were placed on the waitlist. Understanding how the system actually works changes your strategy.

The Five Priority Tiers

Tennessee law mandates that when applications exceed capacity, scholarships are awarded sequentially through these tiers. Every applicant in a higher tier gets funded before anyone in the next tier is even considered.

Priority 1 — Returning EFS students. Families who received EFS in the prior year and submit their renewal application on time are guaranteed continued funding. This tier exists to prevent families from losing their scholarship year to year. For 2026-2027, renewal applications opened December 9, 2025.

Priority 2 — Low-income families, benefit recipients, and disability-eligible students. This tier captures three groups: households with income at or below 100% of the Federal Free and Reduced-Price Lunch threshold, families receiving SNAP or TANF benefits (with a DHS letter dated within 365 days), and students eligible for ESA or IEA programs. For a household of four, the income ceiling was approximately $57,720 for 2026-2027.

Priority 3 — Moderate-income families. Households earning up to 300% of the FRPL threshold. The 2026-2027 limits were $173,160 for a family of four, $143,301 for three, and $113,442 for two. You prove this with Line 9 of your filed federal Form 1040.

Priority 4 — Public school students and kindergarten entrants. Children currently enrolled in a Tennessee public school, or entering kindergarten for the first time. This tier serves families making the switch from public to private school.

Priority 5 — Everyone else. All remaining eligible Tennessee K-12 students who don't qualify for a higher tier. Within this tier, applications are processed in the order completed applications are received.

Why Your Form 1040 Matters More Than You Think

The difference between Priority 2 and Priority 5 can be the difference between guaranteed funding and a 17,000-person waitlist. For the 2026-2027 cycle, income verification uses Line 9 on the 2024 federal Form 1040.

That line shows your total income. If it falls at or below the 100% FRPL threshold for your household size, you qualify for Priority 2. Up to 300%, you're in Priority 3. Above that, you're Priority 4 (if switching from public school) or Priority 5.

For the 2026-2027 cycle, TDOE requires the 2024 Form 1040 for income verification. Handwritten returns and IRS tax transcripts are rejected. If you qualify for SNAP or TANF, an official benefit letter can document Priority 2 eligibility.

How the Waitlist Actually Moves

If enrollment is not verified within 10 school days of the academic term starting, the award is forfeited and remaining funds revert to the State Treasurer. Any further awards follow the same priority-tier order: Priority 2 applicants are considered before Priority 3 applicants, and so on.

The statutory growth trigger adds pressure from the other direction: when completed applications equal or exceed 75% of the prior year's capacity, the state automatically adds 5,000 scholarship slots the following year. For 2026-2027, Governor Lee requested expanding capacity up to 40,000 seats. But even with expansion, applications have outpaced availability every year.
