Idaho School Choice Tax Credit for Special Needs: The $7,500 Disability Tier
The Enhanced Credit Tier
Idaho's Parental Choice Tax Credit provides a higher maximum for students with qualifying disabilities: $7,500 per student per year, compared to the standard $5,000 cap. The credit remains fully refundable — if your family owes nothing in Idaho income tax, the full amount comes back as a direct payment.
This isn't a separate program. It's the same Parental Choice Tax Credit under Idaho Code Section 63-3029N, with a higher cap for students who meet the disability definition.
Who Qualifies for the $7,500 Tier
The statute defines an eligible student with a disability as an Idaho resident between 5 and 21 years old (the standard tier cuts off at 18) who requires "ancillary personnel" as defined under Idaho Code Section 33-2001. A need for a particular service by itself does not establish eligibility; the student must meet the statutory disability and ancillary-personnel criteria.
Families need to provide verification that their child has a qualifying disability requiring ancillary personnel during the TAP application process.
This is also the group eligible for the extended age range. If your child is between 19 and 21 and has a qualifying disability, they remain eligible when standard-tier students have aged out.
What Expenses Qualify
The same five categories apply as for all Parental Choice Tax Credit participants — tuition, core-subject curriculum, academic tutoring from a non-family member, standardized testing, and transportation. The disability tier doesn't unlock additional expense categories; it raises the dollar cap.
That said, the higher cap gives special-needs families more room to claim expenses that are common in their situation. Specialized tutoring for core subjects — a math tutor trained in dyscalculia intervention, or a reading specialist working on decoding — qualifies as long as the tutor isn't a household member. Private school tuition at a school equipped for learning differences counts in full.
One area that does not qualify regardless of tier: therapy services that aren't tied to core academic instruction. Standalone occupational therapy, speech therapy outside an academic context, or behavioral therapy sessions are not covered by the tax credit. The qualified expense must connect to instruction in English language arts, math, science, or social studies.

Advance Payment for Lower-Income Families
If your household's Modified Adjusted Gross Income is at or below 300% of the Federal Poverty Level, your child may also be eligible for an advance payment — funds disbursed within 60 days of your award notice rather than waiting for your annual tax refund.
Important limitation: the advance payment is a one-time-per-student-lifetime option. Once a student receives an advance payment, they cannot receive another in any future year. Future years must go through the standard annual tax credit reimbursement. This applies at the enhanced $7,500 cap too.
Also note that advance payments are treated as federally taxable income in the year received — a detail worth flagging for your tax preparer.
Documentation to Prepare
Before the January 15 application window opens, gather:
- Disability verification — documentation confirming your child's condition requires ancillary personnel under Idaho Code Section 33-2001
- Expense receipts — the same itemized, paid receipts required of all applicants (provider name, description, date, amount, proof of payment)
- Prior-year Idaho Form 40 — must be processed before you can register on the TAP portal
- TAP account — set up by December 1 to ensure verification completes before the window opens
