Florida PEP vs Homeschool: The Legal Status Change Families Miss

PEP Students Are Not Legally Homeschoolers

This is the single most important legal fact families miss. When you accept a PEP scholarship, your child's legal classification changes from "home education student" under Section 1002.41 to "private education choice participant" under Section 1002.395.

State marketing often calls PEP a "homeschool scholarship." That framing obscures the statutory reality. HSLDA explicitly warns families that PEP participants are classified differently from traditional home educators, and HSLDA's policy is that its legal staff will not represent families in disputes over scholarship spending rules or SFO decisions.

What You Must Do to Accept PEP

Before PEP funds can flow, you must terminate your traditional home education registration by filing a formal Letter of Termination with your county school district superintendent. You cannot hold a Notice of Intent under Section 1002.41 and receive PEP funding simultaneously — the SFO's cross-check systems will flag dual enrollment.

The transition sequence matters for compulsory attendance compliance:

  1. Apply for PEP through your chosen SFO portal
  2. Receive and accept the award notification
  3. Complete the Student Learning Plan in the portal
  4. Only then file the Letter of Termination with your county superintendent

Filing the termination before your PEP award is confirmed creates a gap in your child's legal attendance coverage. If the PEP application is delayed or denied, you're in limbo — not registered as a homeschooler and not enrolled in a scholarship program.

The accountability trade-off is clear: you give up portfolio-based evaluation flexibility (where you choose your evaluator and method) for a required annual assessment. You gain funding but add the SLP requirement and the SFO's spending oversight.

FES-UA Doesn't Require This Trade-Off

Unlike PEP, FES-UA recipients directing instruction at home can maintain their Section 1002.41 registration. You keep your county Notice of Intent, continue your portfolio, and still access ESA funding for therapies, technology, and curriculum. Your annual evaluation fees are even covered by FES-UA.

If your child qualifies for FES-UA through a documented disability, this dual-status arrangement gives you both funding and independence.

How to Switch Back

If you leave PEP and want to return to traditional homeschooling:

  1. Submit a formal withdrawal request in the SFO portal
  2. Simultaneously file a new Notice of Intent with your county school district superintendent
  3. Resume maintaining a portfolio and scheduling annual evaluations under Section 1002.41

Both steps must happen together to maintain continuous compulsory attendance coverage under Florida law (Section 1003.21). A gap between dropping PEP and filing the new Notice of Intent can trigger truancy inquiries.

Unspent funds remaining in your PEP account after withdrawal revert to the state. Plan spending accordingly before exiting.

Making the Decision

The choice isn't about which program is "better" — it's about what your family values more. Parents who prize maximum autonomy from state educational mandates and don't need the funding often stay under Section 1002.41. Parents who need $7,600+ per child and can handle the SLP and annual testing requirements find PEP worthwhile.
