CHOOSE Act and Cover School Enrollment: Does the ESA Change Your Homeschool Status?

Your Cover School Status Doesn't Change

This is the question that holds more Alabama homeschool families back from the CHOOSE Act than any other: does taking state money change my legal homeschool status?

The short answer is no. ALDOR Rule 810-28-1-.01 defines "Home Education Program" broadly to include individual homeschools, cover schools, and co-ops. Participating in the CHOOSE Act does not alter your underlying legal status under Alabama Code § 16-28-1 or § 16-28-3.

If you homeschool through a church cover school today, accepting ESA funds means you continue to satisfy compulsory attendance through that same cover school. You don't switch legal pathways. You don't register with a different state agency for your educational status. You add a ClassWallet account that provides funding for approved educational expenses — that's it.

No Testing Required for Homeschoolers

Participating private schools must administer annual standardized testing and submit aggregated results to ALDOR. That requirement applies only to private schools — not to the home education track.

The CHOOSE Act imposes zero state-mandated testing on homeschool participants. No achievement tests, no score reporting, no portfolio reviews. You can voluntarily purchase standardized tests (ACT, SAT, CLT) through ClassWallet, but you're not required to administer them or share results with anyone.

This distinction trips up many families because news coverage of the CHOOSE Act's testing provisions rarely specifies that the mandate applies only to private schools.

No Curriculum Mandates

Alabama's church school pathway already carries no curriculum requirements — parents choose their own materials without state approval. The CHOOSE Act doesn't add any.

Cover School ESP Registration Is Optional

Your cover school doesn't need to become an ALDOR-approved Education Service Provider unless you want to use ESA funds to pay their administrative fees. Many cover schools charge $25–$200 per year for enrollment and record-keeping. If you want ClassWallet to cover those fees, the cover school needs ESP registration. If you're fine paying the cover school out of pocket and using ESA funds elsewhere, the cover school doesn't need to interact with ALDOR at all.

Some cover school administrators have been cautious about ESP registration, worried it invites state oversight. ESPs must keep itemized records for ALDOR's audit of ESA-funded transactions. Some schools have chosen to stay out of the ESP system entirely.

What Leaving the CHOOSE Act Looks Like

If you decide the ESA isn't worth it — or your circumstances change — you simply don't renew. Close your ClassWallet account or let it expire at the end of the school year. Unspent funds return to the state, your cover school enrollment continues as it always has, and there's no exit paperwork with ALDOR beyond the account closure.

You don't lose your church school status by leaving. You don't gain new obligations. The CHOOSE Act is a funding layer, not an educational status.
