School Refusal and Social Services: What Happens When CPS Gets Involved

This is the fear underneath everything else: that if your child does not go to school, someone will knock on your door and question whether you are a fit parent.

It is not irrational. Prolonged school absence — particularly unexcused absence — is one of the most common triggers for educational neglect referrals. In the US, school districts routinely file reports with Child Protective Services when a student accumulates excessive unexcused absences. In England, schools make referrals to local authority social care when non-attendance raises safeguarding concerns.

Understanding how this process works is the first step to making sure it does not escalate.

How Referrals Happen

In the US, prolonged unexcused absence frequently leads to reports to Child Protective Services for suspected educational neglect. Truancy thresholds vary by state; the report may frame the issue as parental failure to provide education even when the absence is driven by the child's inability to attend.

In England, schools may make a referral to local authority children's social care if they believe a child's non-attendance represents a safeguarding concern. This can trigger a Section 47 enquiry under the Children Act 1989 — a formal child protection investigation. A school might also file a Children Missing Education (CME) notification if a child drops off the roll without a clear destination.

The referral is more likely when:

  • Absences are coded as unauthorised and no medical documentation has been provided
  • The school perceives the parent as uncooperative with attendance improvement plans
  • The parent withdraws the child mid-investigation (which some authorities interpret as attempting to evade oversight)
  • There are pre-existing concerns in the family's history

What a Referral Means — and What It Doesn't

A CPS or social care referral is not itself a finding of neglect. It may lead to a safeguarding enquiry; the steps that follow depend on the jurisdiction and the circumstances.

That said, the process can feel frightening and invasive. The emotional impact on a family already in crisis can be significant.

How to Protect Your Family

Document everything from the start. The strongest defence against an educational neglect finding is a documented record showing you have been actively seeking solutions — requesting school accommodations, pursuing clinical assessments, cooperating with attendance meetings, and exploring educational alternatives.

Get clinical documentation before a referral happens. A specialist letter confirming your child's anxiety or burnout, explaining their inability to attend, and recommending educational adjustments reframes the narrative from "parent keeping child home" to "family managing a medical condition."

Do not withdraw without a plan. Mid-investigation withdrawal — pulling your child off the school roll while attendance enforcement or a safeguarding enquiry is active — can escalate the situation. It does not erase prior unauthorised absences, and it can shift the local authority's framing from "attendance default" to "safeguarding concern." If you do withdraw, have your clinical documentation, your educational plan, and your formal withdrawal letter ready simultaneously.

Cooperate professionally. If social services contact you, engage calmly and transparently. Provide your clinical documentation. Show your educational plan (even if it is a recovery-first deschooling plan rather than a formal curriculum). Demonstrate that your child's absence from school is a managed medical response, not neglect.

Understand the distinction between unstructured absence and formal home education. A child who continues to miss school without a clear enrollment or education status can raise attendance and safeguarding concerns. A child who has been formally withdrawn to elective home education, with a clear educational plan and clinical documentation supporting the decision, follows a different legal pathway. Making the transition formally and in writing helps make the child's education status clear.
